Boat Rental Waiver and Release of Liability

This waiver outlines the risks, responsibilities, and legal requirements associated with renting and operating a boat. By signing, you acknowledge and accept these terms, including wearing life jackets, adhering to alcohol and drug restrictions, and ensuring only experienced, licensed individuals operate the boat. You also agree to comply with all laws and take responsibility for any damages or fines incurred.

Assumption of Risk: The undersigned acknowledges that boating involves certain inherent risks, including but not limited to, the risk of personal injury, property damage, or death. The undersigned voluntarily assumes all risks associated with the use of the boat.

Release of Liability: In consideration of being permitted to rent and use the boat, the undersigned agrees to release, waive, discharge, and hold harmless North Texas Pontoon LLC, its owners, agents, and employees from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the undersigned, or any of the property belonging to the undersigned, whether caused by the negligence of the releasees or otherwise, while using the boat.

Indemnification: The undersigned agrees to indemnify and hold harmless North Texas Pontoon LLC, its owners, agents, and employees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of, connected with, or resulting from the use of the boat.

Responsibility for Damages: The undersigned agrees to be responsible for any and all damages to the boat or any other property caused by the undersigned's use of the boat. The undersigned agrees to reimburse [Your Company Name] for any and all damages within 30 days of receiving an invoice for the damages.

Compliance with Laws: The undersigned agrees to comply with all local, state, and federal laws and regulations while using the boat.

Condition of the Boat: The undersigned acknowledges that they have inspected the boat and have found it to be in good operating condition. The undersigned agrees to return the boat in the same condition as it was received.

Alcohol and Drug Use: The undersigned agrees not to operate the boat under the influence of alcohol, drugs, or any other substance that may impair their ability to operate the boat safely. The person renting the boat will not drink, otherwise, they could be charged with a DUI since it is a motor vehicle.

Life Jackets: The undersigned agrees to wear a life jacket at all times while on the boat and to ensure that all passengers do the same. Children under 14 must wear a life jacket at all times while the boat is in motion. If you get a ticket for a child not having a life jacket on, it is your responsibility to go to the court date and pay whatever fine it is.

Operator Requirements: Only experienced and licensed persons will be allowed to operate the boat.

I, the undersigned, have read and understand this waiver and release of liability and voluntarily agree to its terms. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
